An injury to a baby can occur at birth due to a complication during the labor or delivery process. These injuries can occur as a result of an improper use of a medical devices or even techniques during the baby’s delivery. Our firm has seen such cases with medical devices such as forceps or a vacuum. The harm to the baby caused by such action can lead to a variety of injury or damage, including, but not limited to, lack of oxygen, limb or nerve damage or severe head or brain injuries.
In order to recover for an injury occurring during the birth process, you will likely need to show that medical providers and/or a pharmaceutical company failed to give you or your baby adequate medical care or medication advice during pregnancy and/or delivery (this is frequently referred to as “failing to meet the applicable standard of care”.
